Dissolution v. Legal Separation

A marriage may be dissolved by dissolution, legal separation, or by nullity (invalid marriage). In Dissolution and Legal Separation Proceedings, the court rules on the rights and financial responsibilities of the parties. A Dissolution of Marriage dissolves the marriage and restores the spouses to single status. A Legal Separation, on the other hand, rules on the same rights, but without completely dissolving the marriage.

There are several reasons that someone might prefer a legal separation to a dissolution. The primary reason is that because the marriage is not completely dissolved, many insurance providers will not automatically cut off benefits to a  ex-spouse. Another reason could be for religious purposes. It is important to note that if you obtain a legal separation then you cannot remarry until the marriage is completely dissolved.
