A Dissolution of Marriage dissolves the marriage and restores the spouses to single status.  A nullity proceeding, on the other hand determines whether or not the parties were validly married in the first place. If determined that the marriage was invalid from its inception then the parties were deemed never to have been married in the first place. An annulment can be based on several circumstances, but usually occurs when a party is already married or their previous divorce had not been properly finalized. Another reason for an annulment might arise when a party can show that a marriage was perpetrated by fraud. Although somewhat difficult to prove it is not impossible if the fraud relates to an essential aspect of the marriage and was used to induce acceptance of the proposal.
